Cookie Policy

1. Introduction
The proprietors trading under the registered business name Livan Fitness as CrossFit Highfields (ABN 67 657 031 199, referred to here as "we," "us," or "our") use cookies and comparable technologies on the website located at www.crossfithighfields.com.au. The purpose of the present document is to explain, in plain and practical terms, what those technologies are, why we deploy them, the categories into which they fall, and the means by which you may exercise control over them. Our website is built and hosted on the Squarespace platform, and a number of the cookies described below originate from that platform as a necessary incident of its operation.
The document should be read alongside our Privacy Policy, which governs the broader collection and handling of personal information and forms part of the same framework. Where information gathered through cookies can reasonably identify you, it constitutes personal information, and our obligations under Australian privacy law extend to it.
2. What Cookies and Similar Technologies Are
A cookie is a small text file that a website asks your browser to store on your device when you visit. On a later visit, or as you move between pages, the website can read that file in order to recognise your browser, to remember your preferences, or to record how the site is being used. Cookies do not, of themselves, run programs or deliver malware, and they cannot access other files on your device.
Related technologies achieve similar ends through different means. A tracking pixel, sometimes called a web beacon, is a tiny, often invisible image embedded in a page or an email that signals when content has been loaded. Local storage and similar browser mechanisms hold data on your device in a comparable fashion. Throughout this Policy, references to "cookies" should be understood to include these adjacent technologies wherever the context permits.
Cookies are commonly classified by duration. A session cookie persists only for the length of your visit and is discarded once you close the browser, whereas a persistent cookie remains for a defined period or until you delete it, allowing the site to recognise a returning visitor.
3. The Legal Position in Australia
Australia does not impose a discrete statute dedicated to cookies, and there is no general legal requirement to display a consent banner of the kind familiar from European websites. The handling of cookie data is instead regulated through the Privacy Act 1988 (Cth) and the Australian Privacy Principles contained in Schedule 1 to that Act. Where data collected through a cookie or a tracking pixel is reasonably capable of identifying an individual, the Office of the Australian Information Commissioner treats it as personal information, with the consequence that the transparency and collection standards of the APPs apply.
Regulatory expectation has tightened. Guidance issued by the Office of the Australian Information Commissioner on tracking pixels confirms that organisations must understand, and must disclose clearly, the information their tracking technologies collect and the parties with whom it is shared. Consistent with the direction of recent reform, we do not rely on pre-ticked boxes or on bare assertions that continued use signifies agreement; instead, non-essential cookies are withheld until a positive choice is made through the mechanism described in Section 6. Because our services are offered to the Queensland and Australian community, and not to individuals within the European Union, the European General Data Protection Regulation does not apply to our operations.
4. The Categories of Cookies We Use
The cookies present on our website fall within the following categories, distinguished by the function each performs.
Strictly Necessary Cookies: Certain cookies are essential to the basic operation of the website, supporting core functions such as page navigation, security, and the integrity of the platform on which the site is built. Cookies of this nature cannot be switched off through the consent banner, because the site would not function correctly without them, and they do not gather information used for marketing.
Functional and Preference Cookies: A second group remembers choices you make, improving your experience by retaining settings and preferences across pages and visits. The information held by these cookies may be anonymous, or it may relate to you where you have identified yourself.
Analytics and Performance Cookies: A further category gathers aggregated information about how visitors find and use the website, including the pages viewed, the time spent, and the general path taken through the site. Insight of that kind assists us to identify which content is useful and where the site may be improved. Cookies in this group are not essential, and you may decline them.
Advertising and Targeting Cookies: As our marketing activity develops, we use, or intend to use, cookies and pixels that measure the effectiveness of advertising and that allow relevant content to be presented to audiences on third-party platforms. Technologies of this character are non-essential and are activated only where you have consented.
5. Third-Party Cookies and the Tools We Rely Upon
A portion of the cookies operating on the website are set not by us directly but by third-party providers whose services we have integrated. The principal providers are identified below, together with the function each performs.
Squarespace Platform Cookies: Because the website is hosted on Squarespace, the platform sets cookies necessary for the site to load, to remain secure, and to operate as intended. Squarespace also provides the analytics and consent functionality on which the controls described in this Policy depend.
Google Analytics: A web analytics service supplied by Google that reports, in aggregate and de-identified form, on how visitors interact with the website. When added through the platform's settings, the service is configured to respect the consent choice you express through the cookie banner. Further information concerning Google's handling of data is available at policies.google.com/privacy, and an opt-out browser add-on is offered at tools.google.com/dlpage/gaoptout.
Meta (Facebook) Pixel: A measurement and advertising tool provided by Meta Platforms that records actions taken on the website, enabling us to assess the performance of advertising and to reach relevant audiences across Facebook and Instagram. Meta's data practices are described at www.facebook.com/privacy/policy.
Each third-party provider operates under its own privacy and cookie terms, which govern the data it collects in addition to the protections set out here. We do not control the cookies set by these parties beyond the configuration choices the platform makes available to us.
6. How We Obtain Your Consent
When you first arrive at the website, a cookie banner generated by the Squarespace platform is presented to you. The banner offers a genuine choice: you may accept non-essential cookies or decline them. Where the opt-in and opt-out configuration is engaged, analytics and advertising cookies, including those associated with Squarespace Analytics, Google Analytics, and the Meta Pixel, are suppressed and do not drop onto your device until you signify acceptance. Strictly necessary cookies, by contrast, operate regardless, because the site cannot function without them.
Your choice is not irrevocable. You may revisit and alter your preferences at any time, either by adjusting the cookie settings presented through the website or by managing cookies directly within your browser, as described in the section that follows. Consent given on one occasion does not bind you indefinitely, and a withdrawal takes effect prospectively from the moment you make it.
7. Managing and Disabling Cookies Through Your Browser
Independently of the controls offered on the website, every major browser allows you to view, restrict, block, or delete cookies. The relevant settings are ordinarily found within the privacy or security menu of the browser, and the providers maintain detailed instructions, including those for Google Chrome, Mozilla Firefox, Microsoft Edge, and Apple Safari. You may configure your browser to reject all cookies, to accept only those from sites you trust, or to alert you before a cookie is stored.
A degree of caution is warranted. Should you elect to block or delete strictly necessary cookies, parts of the website may cease to function correctly, and certain features may become unavailable. Disabling non-essential cookies, by contrast, carries no such consequence for the core operation of the site and simply limits the analytics and advertising functions described above.
8. Do Not Track Signals
Some browsers transmit a "Do Not Track" signal expressing a preference that your online activity not be monitored. No consistent industry standard yet governs how such signals are to be interpreted, and the responses of third-party providers vary. We give effect to your preferences principally through the consent mechanism and the browser controls set out in this Policy, and we encourage you to rely on those tools as the most reliable means of regulating the cookies placed on your device.
9. Overseas Handling of Cookie Data
Several of the providers identified in Section 5, including Squarespace, Google, and Meta, maintain infrastructure outside Australia, principally in the United States. As a result, information collected through certain cookies may be stored or processed overseas. The safeguards applicable to that handling, and the basis on which we rely on these providers under Australian Privacy Principle 8, are addressed more fully in our Privacy Policy, to which this document is a companion.
10. Changes to This Cookie Policy
Our use of cookies may evolve as our website, our analytics arrangements, and our marketing activity develop, and the law itself continues to advance. We may therefore revise the present Policy from time to time, publishing the current version at www.crossfithighfields.com.au with the date of its most recent revision shown above. Continued use of the website following the publication of an amended version signifies your acceptance of the revised terms, and where a change is material, we will take reasonable steps to draw it to your attention.
